What the vendor guidance establishes
ElevenLabs’ help page says its free plan does not include a commercial licence. It describes commercial use under paid plans subject to conditions, including rights in the content and an exclusion for Beta Services. Do not assume upgrading later licenses earlier free-plan output. ElevenLabs publication guidance, checked 16 September 2026.
This is a summary for purchasing research, not legal advice or clearance for your production. Read the current agreement for the exact product and ask the vendor to resolve any ambiguity in writing.
Keep a rights record before generation
For each production, record:
- Vendor, product, model and subscription or API plan.
- Generation date and proof of the plan active at that time.
- The applicable terms and their retrieval date.
- Voice identity, where the voice came from and permission for the intended use.
- Script, music and other third-party material used in the output.
- Intended distribution: client work, an advertisement, a game, a video or an audiobook.
- Any attribution, disclosure, territory, expiry or platform requirements that need confirmation.
Keep this with the audio masters, not only in a vendor dashboard. A licence statement about the platform does not establish consent from a person whose voice is being cloned.
Resolve conflicting product terms
Our Fish Audio research note records an unresolved scope question between general service terms and model-specific documentation. That is a reason to ask about the exact plan and model, not a reason to advertise blanket free commercial rights.
Suggested question for the vendor: “For this model and plan, can I distribute the generated narration in this named commercial project? Which terms apply, and what voice permissions or attribution do I need?” Do not send private scripts or voice recordings merely to ask this question.
Check the destination separately
Before production, consult the current policies of the intended distributor and client. A vendor licence does not prove that a video platform, audiobook distributor or client accepts that format or synthetic narration. Obtain specialist advice where the project involves another person’s identity or uncertain rights.
Should rights affect the shortlist?
Yes: unresolved permissions are a purchase blocker even if an audition sounds good. Compare the documented tool notes and production cost only after you can document the intended use. Neither tool has earned a hands-on recommendation here yet.
